The BAD News: Litigation Against Employers Is Rising.
The Equal Employment Opportunity Commission (“EEOC”) recently released some bad news: The EEOC filed 50% more employment discrimination lawsuits against employers in fiscal year 2023 than it did in 2022.
When announcing the news, EEOC Chair Charlotte A. Burrows said, “The EEOC’s litigation program is an important tool to ensure compliance with the nation’s anti-discrimination laws and promote equal employment opportunity when the Commission is unable to obtain voluntary compliance.”
Litigation against employers is rising.
This is bad news for employers and employees alike. It undermines a productive work environment and costs everybody time and money. Pre-litigation investigations alone can cost employers approximately $25,000 to $50,000 in legal fees, and this number can quickly soar into six figures if plaintiffs pursue their employer in court.
Not only is litigation against employers rising, but so are the costs of litigation.
